June 17, 2025 – chátlich (Sechelt), BC — shíshálh Nation acknowledges the recent ruling under the Heritage Conservation Act (HCA), which confirmed the unlawful disturbance of a sacred site, xwuxwkwiwan, within our swiya. Delivered in the heart of our swiya, this decision is a historic moment: the first ruling of its kind, and the first ever heard and hosted within our longhouse.
We raise our hands to the court for accepting our invitation to deliver the verdict in a space that holds our laws, our teachings, and our spirit. To hold these proceedings in our longhouse was not merely symbolic, it was a living expression of who we are, and how justice must be grounded in place, protocol, and the presence of our people.
This moment is historic. But it is also solemn.
The ruling affirms what we have always known: our sacred sites must not be disturbed, and our connection to the land is undeniable. While this decision sets a precedent, it does not repair the harm that has been done. The burden of that harm continues to fall on shíshálh Nation, as it has for generations.
We did not go to court seeking recognition. We did it for our children, our Elders, and for the sacred responsibility we carry to protect the swiya. We honour the strength of our community, our leadership, and our ancestors who guided us through this journey. Their teachings continue to guide us. This is our responsibility.
While this decision is a significant step, it cannot be the last.
A ruling alone does not heal. Recognition without restoration is not enough.
shíshálh Nation calls on the Province of British Columbia to continue taking meaningful steps toward reconciliation:
- Reform the Heritage Conservation Act in full partnership with Indigenous Nations;
- Ensure penalties and reparations are directed to those harmed, not the Crown;
- Embed Indigenous jurisdiction and consent into every aspect of heritage protection.
We also encourage Indigenous leaders across the province to continue advocating for their communities and protecting the lands, waters, and stories that define their land and their people. Together, we are building a stronger path forward, one that honours our past and safeguards the future.
shíshálh Nation will continue to speak for the land, the waters, and all that is held within the swiya. We act not only for today, but for our grandchildren, their children, and the generations to come. And we will not stop.
We thank our Elders, our youth, our community, and our ancestors for walking with us. This decision may be a beginning, but the journey to justice is far from over.
